CODE OF CONDUCT
The purpose of the AEMC Code of Conduct is to establish ethical standards by which members of the AEMC are expected to operate. These ethical standards may be subject to amendment from time to time; Members should ensure that they remain conversant with the code as it evolves.
Principle 1 - "Integrity" Member companies shall conduct its business in an honest, trustworthy, competent, and ethical manner and shall at all times conduct its affairs courteously and in accordance with good professional practice
Principle 2 - "Compliance" Member companies shall comply with all applicable legislation relating to taxation, national insurance, working time directive, employment law, equal opportunities, health and safety, and data protection.
Principal 3 - "Operational Methodology" Member companies shall operate as PAYE employers. All payments to freelance contractors shall be subject to legal requirements relating to PAYE and National Insurance without use of any tax avoidance device, for example payment as dividends, loans or bonuses, or through use of employee benefit trusts or offshore companies.
Principle 4 - "Competence" Member companies shall ensure that staff:
- shall remain informed on issues essential to the conduct of the business and through training or other methods retain necessary skills
- through training or other methods maintain sufficient knowledge of contemporary technology and developments relevant to the Member work requirements
- are suitable and competent to perform work within the business
- do not make any representation to an employment business, hirer or proposed or actual freelance employee that is not full and accurate
- are suitably trained to act in accordance with the Principles herein
Principle 5 - "Professionalism" Member companies shall use the fact of Membership in AEMC in a professional manner that is consistent with the Code of Ethics. Member companies shall not do anything that may be in conflict with the best interests of an employment business or hirer ("client") without first advising the client of the potential conflict and giving the client an opportunity to end any contract except as allowed for under any contractual arrangements.
Principle 6 -"Industry" Member companies shall at all times act in the best interests of the employment management industry and shall not act in a way likely to bring that industry or the recruitment industry into disrepute.
Principle 7 - "Equality" No Member's business shall allow unlawful discrimination among its employees or clients on grounds of race, sex, national origin, religion, disability, or on any other unlawful basis.
Principle 8 - "Awareness" The Member company shall ensure that any person, other than a freelance employee, engaged by it, shall be made aware of the AEMC Code of Ethics and shall agree to act in accordance with the Principles.
